Note: This English version is provided for convenience only. The Polish version of these Terms and Conditions is the sole legally binding text and shall prevail in case of any discrepancy.
1. Repaired equipment is covered by a 24-month warranty in the case of replacements of optical drives, hard disks and RAM, a 12-month warranty for replacements of laptop and monitor displays and UPS battery replacements, a 6-month warranty for laptop repairs (excluding BGA component reflow/reballing, which carries a 3-month warranty period), desktop computer sets and monitors, a 1-month warranty for X-Box game console repairs, and a 6-month warranty for all other equipment repaired at A&D Serwis Europejskie Centrum Serwisowe®.
2. The exclusion of the 6-month warranty, reduced to 3 months, applies to BGA component replacements and laptops damaged by liquid spills.
3. The warranty period is calculated from the agreed equipment collection date.
4. Diagnostics. As of 1 July 2017, our computer electronics department introduced a paid diagnostics fee. A paid diagnosis means that if the customer cancels the repair or the repair cannot be carried out, the customer will be charged in accordance with the list below. However, if the repair is completed successfully, this cost is included in the repair price. a) for laptops, computers, televisions and robot vacuum cleaners the diagnostic fee is PLN 80, b) for monitors, tablets, PC motherboards and UPS units up to 1500 kVA the diagnostic fee is PLN 80, c) for UPS units from 1600 kVA to 5000 kVA, the diagnostic fee is PLN 100; for other devices, prices are set individually on the day the equipment is accepted for repair. The cost of preparing a specialist opinion for an insurer, containing information on the damage and its possible causes, is PLN 150.
5. Handing over equipment for repair is equivalent to consent to the repair up to the maximum net threshold prices, which for particular devices are as follows:
a) Laptop/notebook, netbook and robot vacuum cleaner repairs up to PLN 500,
b) Tablet and e-reader repairs up to PLN 400 — repairs temporarily suspended,
c) Multimedia projector repairs up to PLN 400,
e) Desktop computer set repairs up to PLN 500,
g) Motherboard repairs up to PLN 500,
h) CRT monitor repairs up to 19" up to PLN 400, above 19" up to PLN 500,
i) LCD monitor repairs up to 19" PLN 300, above 19" up to 22" PLN 350, above 22" PLN 400,
j) Industrial monitor repairs up to PLN 600,
k) LCD television repairs up to 37" PLN 400, LCD and Plasma televisions above 37" PLN 600,
m) Server power supply repairs up to PLN 600,
p) UPS repairs: a) up to 0.7 kVA from PLN 100, b) up to 1.5 kVA from PLN 300, c) up to 2.5 kVA from PLN 500, d) up to 3.5 kVA from PLN 700 (higher power ratings priced after inspection); e) for UPS battery replacement including calibration service, a flat fee applies: up to 0.7 kVA PLN 80, up to 1.5 kVA PLN 100, up to 3 kVA PLN 150. Above this, price to be agreed plus the cost of batteries.
If the maximum threshold repair price is exceeded, the customer will be informed by phone or e-mail. If the customer does not agree to proceed with the repair, the equipment will be returned to the customer subject to the diagnostic fees stated in point 5 of these Terms. At the customer's request, we will also issue a service report on the diagnosis performed in such a case; this does not apply to specialist opinions for insurers, which are separately chargeable. Only customers who sent equipment for repair via our courier are required to cover transport costs. This amounts to PLN 14.50 net (+ PLN 5 for additional insurance, if selected) for a shipment up to 31.5 kg, or PLN 160.00 net for a Euro-pallet, one way within Poland, plus costs in line with the current price list published under the Euro Service tab for customers outside Poland. Regardless of the customer's choice, in the case of orders placed via the shipping system on our website: https://www.aid-serwis.com.pl/wyslij-sprzet/ specialist industrial, medical or military equipment will, regardless of the customer's choice, be returned on the day of dispatch with additional insurance covering PLN 50,000, at a cost of PLN 39.00 net, or PLN 160.00 net for a Euro-pallet.
6. If equipment cannot be repaired for reasons beyond the service centre's control: (unavailability of spare parts, motherboard damage caused by delamination, whiskering, etc.), the customer may leave the equipment free of charge for disposal. The customer is only required to cover the diagnostic and transport costs in line with the price list applicable on the date of shipment (applicable to customers using A&D Serwis transport).
7. A&D Serwis shall not be liable to the Buyer / Customer for any indirect or consequential damages, such as financial loss or lost profit, as well as damages resulting from the temporary inability to use equipment, temporary loss of the ability to conclude or perform contracts, loss of potential business opportunities, loss of goodwill, downtime costs, loss of production or reduced production capacity, or any other damages not directly related to the event causing the loss. A&D Serwis also shall not be liable for any damages arising from the improper selection of Products, their improper use, or use inconsistent with their intended purpose or the operating and maintenance instructions, nor for any damages whose occurrence or extent was affected by the condition and characteristics of the infrastructure within which the Products are to be operated, in particular the components with which the Products are to be connected.
8. By handing over the equipment, the customer declares that in the event of refusal to accept the equipment after repair (applicable to customers who choose cash-on-delivery payment), or failure to make payment for the service rendered within 3 months (from the date the quotation was received electronically, applicable to customers choosing bank transfer payment), this constitutes the customer's declaration of intent to transfer ownership of the equipment to the service centre.
9. In accordance with the Personal Data Protection Act (Journal of Laws No. 133, item 883), I consent to the processing of my personal data for marketing purposes by A&D SERWIS, and I also consent, within the meaning of the Act on the Provision of Electronic Services (Journal of Laws No. 144, item 1204), to receive by e-mail information on current promotions and information concerning equipment submitted / handed over for repair at A&D Serwis Europejskie Centrum Serwisowe® spółka z ograniczoną odpowiedzialnością spółka komandytowa and A&D Serwis PRO Europejskie Centrum Serwisowe Sp. z o.o.
10. If a repair cannot be carried out, the service centre reserves the right to return the faulty equipment with slightly altered fault symptoms. This is due, among other things, to the fact that most circuits on motherboards are mounted using SMD, BGA, uBGA, CSP and FLIP CHIP technologies. In many cases the cause of a fault is a so-called cold solder joint (micro-cracks in soldered connections); however, it may only become apparent after removal that this has damaged a given chip which is no longer available on the market. Another possible cause is damage to the motherboard's laminate itself due to coating delamination, which prevents correct reflow of a BGA chip. In such cases, for reasons beyond the service centre's control, the customer may receive unrepaired equipment showing altered fault symptoms.
11. Warranty repairs. Detailed information on warranty periods is set out in point 1 of these Terms. Equipment submitted by the customer under a warranty granted by A&D Serwis will be repaired as quickly as possible, within a maximum of 14 business days. If a previously repaired fault cannot be fixed during the warranty period, A&D Serwis will refund the repair cost. The refund will be reduced by the diagnostic fee. Where a VAT invoice was issued, the refund will be made on the basis of a corrective VAT invoice signed by the customer, as quickly as possible and within a maximum of 31 business days. For customers who send the corrective invoice by post or courier, the time limit runs from the date the corrective invoice is delivered to A&D Serwis's premises.
12. The service centre shall not be liable for the loss of data or programs stored on the hard disks of equipment submitted for repair. We therefore ask that, before sending equipment for repair, you back up any data stored on hard disks. We also advise that during the repair process we do not format hard disks or remove any data or programs from them.
13. By submitting equipment for repair, the customer declares that the data and programs installed and stored on the hard disk and any other media provided are their own property.
14. The stated 7-day repair time is indicative only, and the deadline may change if parts need to be sourced or complications arise during the repair.
15. We are aware that customers would in any case eventually dispose of returned electronic components replaced during the repair process as household waste; in line with the WEEE Directive on the handling of waste electrical and electronic equipment, we do not release damaged parts and components. Most electronic components contain harmful and hazardous substances, including lead, cadmium, mercury, chromium, polybrominated biphenyls and polybrominated diphenyl ethers. Accordingly, damaged parts and components will only be released at the customer's specific request, and after completing and attaching to the equipment sent for repair the declaration available under the National Service and Euro Service tabs. In all other cases, used components will be handed over by our company to specialist recycling facilities. Please notify us of your wish to have replaced parts returned on the day the equipment is submitted for repair; otherwise it will automatically be sent for sorting, which will make return impossible.
16. If a replacement laptop is loaned for the duration of a repair, the customer is provided with equipment fitted with the original operating system. By borrowing the equipment, the customer declares that they will not install illegal software on the loaned equipment, nor use it for purposes inconsistent with applicable law. Installing illegal software is prohibited and may result in civil and criminal liability to the fullest extent permitted by law.
17. On 25 May 2018, Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (referred to as the "GDPR"), came into force.
We would therefore like to inform you about the processing of your data and the rules that apply as of 25 May 2018.
What data are we talking about?
This refers to personal data collected while you use our websites, services and other functionalities of our service, including data stored in cookies.
Who will be the controller of your data?

What are the legal bases for processing your data?
Any processing of your data must be based on an appropriate legal basis consistent with applicable regulations. The legal basis for processing your data for the purpose of providing services is the necessity to perform contracts for their provision (these contracts are usually terms of service or similar documents available within the services you use). The legal basis for tailoring service content to your interests, ensuring their security, carrying out measurements and improvements, as well as our own marketing, is the so-called legitimate interest of the controller. Processing of your data for the marketing purposes of our clients, including profiling, and for analytical purposes, will take place on the basis of your voluntary consent, which you give by handing over equipment for repair at our company or by ticking the "I agree" button available in the shipping service.
Accordingly, using our company's services is equivalent to giving consent to the processing, for marketing purposes (including profiling) and analytical purposes, of your personal data collected while you use our websites, services and other functionalities, including data stored in cookies, by our Company and Trusted Partners, also after the GDPR takes effect (i.e., after 25 May 2018).
Giving this consent is voluntary, and you may withdraw it at any time; however, withdrawal of consent will not affect the lawfulness of processing carried out on the basis of consent before its withdrawal.
22. All legal disputes that cannot be resolved amicably will be handled by D.A.S. Towarzystwo Ubezpieczeń Ochrony Prawnej S.A., under an agreement pursuant to which A&D SERWIS Europejskie Centrum Serwisowe® spółka z ograniczoną odpowiedzialnością spółka komandytowa and A&D Serwis PRO Europejskie Centrum Serwisowe Sp. z o.o. are covered by the Company's Legal Protection Insurance Policy.
1. In the event of late payment, the buyer will pay the seller contractual interest of 0.25% of the outstanding amount for each day of delay.
2. This provision also constitutes a final demand for payment in the event of the debtor's default.
3. Title to goods issued and to components fitted during the repair process passes to the buyer upon payment of the full amount (retention of title within the meaning of Articles 589-591 of the Polish Civil Code). Until payment is made, the goods issued and components fitted remain the property of A&D Serwis Europejskie Centrum Serwisowe spółka z ograniczoną odpowiedzialnością sp.k.
4. The date of payment is the date on which the creditor's account is credited.
5. For cash-on-delivery payments, the only proof of payment is a confirmation of payment to the courier, legibly signed by a courier authorised to issue payment confirmations.
6. For cash payment against an invoice, the only proof of payment is a VAT invoice stamped and signed by an employee.
7. Liability under statutory warranty (rękojmia) for physical defects of the goods is excluded.
8. The provisions of points 1 to 8 constitute an essential condition for the parties' conclusion of this agreement, without which the agreement would not have been concluded.
